Who am I?

Laurent, born in Nîmes in the last century. As a child, I grew up in the South of France, between the Cévennes and the Camargue, Provence and Occitania. Travelling and meeting other people have shaped my life. Alongside my activities as a musician-actor-producer, I have perfected my knowledge of this region by working as a holiday advisor-guide in various tourist offices in and around the Gard. I'm always sensitive to sustainable development and the meaning given to my actions.

The Nîmes Arena is a Roman amphitheatre built at the end of the first century. They represent the identity of this French Rome.

1 - PURPOSE

These General Terms and Conditions of Sale (GTCS) apply to the tourist guide services services offered on the Gamindusud website, and detail the rights and obligations of rights and obligations of Gamin du Sud, represented by Laurent MICHEL and its client, whether a natural person or a legal entity, in the context of the sale of a guided tourist guided tour. Any service provided by Gamin du Sud therefore implies unreserved acceptance by of the purchaser to the present general conditions of sale.

2 - SERVICES OFFERED

The services offered by Gamin du Sud are personalised guided walks in the Gard and neighbouring departments, which include: The preparation of a tailor-made itinerary according to the tastes of the Customer, a a guided tour with Laurent MICHEL, service provider, representative of Gamin du Sud and tourist guide, with a gourmet break including a tasting of local products. products. Entrance fees to sites, monuments, museums, parks, etc. are not included, nor are lunches on full-day tours. As part of a sightseeing tour, on request and if possible, Gamin du Sud can take care of the transport of the customer and bring him back to an agreed point. Under no circumstances will Gamin du Sud be able to transport, like a taxi or vtc or vtc, the customer outside a tourist circuit. The seller reserves the right to modify the present terms and conditions at any time by by publishing a new version on its website. The GTC applicable at that time are those in force on the date of payment for the order. 3 - RESERVATIONS, TARIFFS, TERMS OF PAYMENT AND CONCLUSION OF THE CONTRACT

The Customer must follow a series of specific steps in order to complete the order. Choice of product: Customers may book by contacting the Provider by email: contact@gamindusud.com, by telephone on 06 35 34 91 88, or via the form on the "Contact" page of the www.gamindusud.com website. When contacting the Provider, the Customer must indicate the package they wish to book or an à la carte service they require. The Supplier will reply to the Customer by email or telephone within 48 hours, asking about the dates of their stay, the number of people, the language spoken, the themes chosen, their tastes and expectations. Based on the information received, the Provider will send the Customer a personalised quote by email, with suggested itineraries and descriptions. This stage is entirely free of charge and without obligation for the Customer. Indicative prices for the various services appear on the website under the heading "Tours". The "child" price applies to people aged between 6 and 12 accompanied by an adult. 

Order confirmation for private customers : If the proposal is acceptable to the Customer, for reasons of organisation and commitment with a service provider or partner, the Customer must pay a deposit of 100% of the total price of the order by bank transfer or cheque. The Service Provider's bank details will be sent by e-mail. The Customer must also send back the signed quotation with the mention "bon pour accord". This deposit and the signed quotation constitute firm and definitive confirmation. This stage is essential in order to book the service. In the event of a "last minute" booking less than 24 hours before departure, payment for the service will be made in cash at the start of the tour. Any order implies acceptance of the prices and description of the products available for sale. 

Order confirmation for professionals : The same applies as for private customers, except that the reservation must be accompanied by payment of a deposit of 30% of the total cost of the service, which constitutes a substantial and determining condition of the reservation. At the end of the visit, an invoice will be sent for payment of the balance. Payment must be made within 30 days of the invoice date. In the event of total or partial non-payment of the service within 60 days of the date of acceptance, the purchaser must pay Gamin du Sud a late payment penalty equal to 30%. This penalty is calculated on the amount of the outstanding sum, and runs from the due date of the price without any prior formal notice being necessary. If, within thirty days of the implementation of the "Late Payment" clause, the buyer has not paid the outstanding sums, the sale will be cancelled by operation of law and may give rise to a claim for damages against Gamin du Sud. 

An invoice is provided by the Service Provider and given to the Customer once the service has been completed. 

Any order implies acceptance of the prices and description of the products available for sale. 

Prices are quoted in euros, exclusive of VAT.

4 - CANCELLATION AND MODIFICATION

Cancellation of the service by Gamin du Sud or the customer after confirmation of the booking is subject to the following provisions. 

A) Cancellation attributable to Gamin du Sud

Gamin du Sud undertakes to be present on the date, at the time and in the place specified at the time of booking. In the event of force majeure or exceptional circumstances preventing Gamin du Sud from providing the service (illness, accident), the client will be reimbursed the full amount of the service.

B) Cancellation attributable to the customer

If the customer cancels the service within the time limits set out below, Gamin du Sud may deduct the cost of the service:

  • More than 30 calendar days: 0 %. Free cancellation. Full refund.
  • Between 15 and 30 calendar days before the start of the service: 50% of the total price of the service. 50 % refund.
  • Less than 15 calendar days before the start of the service: 100% of the total price of the service.

Any service cancelled in the fortnight preceding the service is payable in full, except in cases of force majeure.

If the customer cancels after the scheduled appointment time or fails to show up at the appointment location, no refund will be made and the price of the visit will be due in full. The time at which the service ends remains that established in the contract when the order was taken. The customer must ensure that he or she is at the time and place of the appointment before the start of the tour. In the event of lateness :

  • Group delay :

The guide will wait for the group for 30 minutes after the meeting time specified on the confirmation. The visit will be shortened by the duration of this delay or, subject to availability and the agreement of the guide and the group, may be extended by the same amount of time. After 30 minutes' waiting time, the guide reserves the right to cancel the tour, without any refund being made for costs incurred by the customer.

  • Guide delay :

The group will remain waiting for the guide for 30 minutes. Subject to the availability of the guide and the agreement of the group, the visit may be extended by the amount of the delay (with a tolerance of 10 minutes). After half an hour's delay, the group has the right to cancel the visit and claim compensation, which may not exceed 50% of the price of the visit initially planned. Compensation of 100 % will also apply if the guide does not turn up.

5 - RESPONSIBILITIES

  • The Service Provider's liability

The Provider is not responsible for the deficiencies of the partners and service providers it recommends to its Customer (restaurants, hotels, leisure activities, etc.). The Provider accepts no responsibility for the personal safety or property of the Customer.

  • Customer responsibility

The Customer alone can be held responsible for any incident or accident that may occur during a walk, for problems caused by walking, falling or any other damage that may occur during the walk, and for the theft or loss of personal belongings during the excursion. The provider cannot be held responsible for any costs or other liabilities associated with an accident, the weather or any religious act, nor for any damage caused to the property of third parties.

6 - INSURANCE

In case of accident during the service, on the person of the guide or the customers, as with thirds, Gamin du Sud and its customer will be able to deal with their insurance companies. The professional civil liability of Gamin du Sud represented by Laurent MICHEL is insured by Axa. It is recommended that participants are covered by civil liability or travel insurance.

7 - PROTECTION OF PERSONAL DATA

In application of law 78-17 of 6 January 1978, amended in 2004, it should be noted that the personal data requested from the Customer is necessary to process the order and to draw up invoices, in particular. In accordance with current national and European regulations, the Customer has a permanent right of access, modification, rectification and opposition with regard to information concerning him or her. 8 - INTELLECTUAL PROPERTY RIGHTS

The brands, domain names, products, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of the Service Provider Gamin du Sud. No transfer of intellectual property rights is made through these GCS. Any total or partial reproduction, modification or use of these assets for any reason whatsoever is strictly prohibited.

9 - DISPUTES

Failing amicable agreement, any dispute relating to the application of these general terms and conditions of sale, their validity, interpretation, performance and more generally any dispute relating to the service, will be brought before the competent courts of the city of Nîmes under the conditions of common law.

10 - APPLICABLE LAW

All clauses contained in these general terms and conditions of sale, as well as all purchase and sale transactions referred to herein, shall be governed by French law. It is written in French. In the event that it is translated into one or more languages, only the French text will be deemed authentic in the event of a dispute.
